Standard terms and conditions for hire of machines and equipment from Open Hire (Midrand).

1. Scope and Acceptance

These standard terms apply to all machine and equipment hires from Open Hire unless agreed otherwise in writing.
By hiring or purchasing equipment from Open Hire, the customer confirms awareness of and agreement to these terms.

The hirer must inspect the equipment and sign the delivery note once satisfied it is working.
Equipment is issued in operational condition and must meet applicable safety requirements.
Equipment must be returned clean, operational, and undamaged except for normal wear and tear.
Return defects are repaired at the customer’s cost; if repair is not economically viable, replacement cost is payable.

The customer is responsible for use of the equipment and for ensuring operators have required competence.
Equipment may only be used for intended tasks and conditions, following operating instructions and safety practices.
Capacity limits must not be exceeded and equipment must not be exposed to undue environmental stress.
No unauthorised modifications are allowed.
Correct oil and lubricant levels must be maintained at all times.

The customer may not sublet the equipment, transfer rights under the agreement, or dispose of rental equipment.
Risk transfers to the customer when equipment is dispatched or collected and remains until returned to Open Hire.
The customer is liable for theft, damage, personal injury, consequential damages, and parts that break during use.

The terms document provides signature fields for both lessor and lessee, with date fields for execution.
